Dermalaser LLC
Effective Date: July 28, 2026
Last Updated: November 3, 2026
Location: Miami-Dade County, Florida
These Terms of Service, Client Policies, and Arbitration Agreement (“Terms”) govern your use of Dermalaser LLC’s website, online booking tools, communications, products, services, appointments, packages, memberships, promotions, loyalty program, gift cards, and related client services.
By using our website, booking an appointment, purchasing a service, purchasing a product, purchasing a package or membership, participating in a promotion, submitting your contact information, communicating with us, or receiving services from Dermalaser LLC, you acknowledge that you have read, understand, and agree to these Terms.
These Terms include a required binding arbitration agreement and jury trial waiver. Arbitration is a condition of using Dermalaser LLC’s website, booking services, purchasing products, purchasing packages or memberships, participating in promotions, and receiving non-emergency elective aesthetic, wellness, skincare, laser, body, massage, or related services. If you do not agree to the arbitration agreement, you should not use the website, book services, purchase services, or receive services from Dermalaser LLC.
If you do not agree with these Terms, you should not use our website, book services, purchase services, or receive services from Dermalaser LLC.
These Terms are intended to be read together with Dermalaser LLC’s Privacy Policy, client intake forms, consent forms, treatment-specific disclosures, package agreements, membership agreements, financing agreements, and any other written agreement signed or accepted by you.

2. Eligibility
You must be at least 18 years old to book, purchase, or receive services on your own behalf.
Clients under 18 may receive certain services only with the consent and involvement of a parent or legal guardian, and only when Dermalaser LLC determines that the service is appropriate.
By booking or purchasing services, you represent that the information you provide is true, accurate, current, and complete.
3. No Emergency or Primary Medical Care
Dermalaser LLC is not an emergency medical provider. Our website, booking system, social media, text messages, emails, and other communications are not intended for medical emergencies.
If you are experiencing a medical emergency, call 911 or seek immediate medical attention.
Information provided by Dermalaser LLC online, in marketing materials, or in general communications is for informational and service-related purposes only. It is not a substitute for medical diagnosis, medical treatment, or advice from your physician or other qualified health care provider.
4. Consultations, Intake Forms, and Medical Suitability
Certain services may require a consultation, intake form, consent form, medical history review, patch test, provider approval, or treatment-specific authorization before treatment.
You agree to fully and accurately disclose all information requested by Dermalaser LLC, including:
- Medical conditions
- Medications
- Allergies
- Pregnancy or breastfeeding status
- Recent sun exposure
- Skin conditions
- Recent cosmetic procedures
- Recent laser or aesthetic treatments
- Use of retinoids, Accutane/isotretinoin, antibiotics, photosensitizing medications, or other relevant medications
- History of scarring, keloids, pigmentation issues, cold sores, or skin reactions
- Any other information that may affect treatment safety or results
Dermalaser LLC may refuse, delay, modify, or discontinue any service if we determine that the service may not be appropriate, safe, or suitable for you at that time.
You are responsible for informing Dermalaser LLC of any changes in your health, medications, skin condition, pregnancy status, sun exposure, or other relevant circumstances before each appointment.
5. Results Are Not Guaranteed
Aesthetic, wellness, laser, skincare, body, and related services vary from person to person.
Results depend on many factors, including skin type, hair color, hair type, treatment area, age, hormones, lifestyle, medical history, sun exposure, consistency with appointments, compliance with instructions, and individual response to treatment.
Dermalaser LLC does not guarantee any specific result, outcome, number of sessions, degree of improvement, permanent result, or complete elimination of any condition.
6. Client Responsibilities
You agree to:
- Arrive on time for scheduled appointments.
- Complete all required forms honestly and completely.
- Follow all pre-treatment and post-treatment instructions.
- Notify Dermalaser LLC of any contraindications, medications, medical conditions, pregnancy, sun exposure, skin irritation, recent procedures, or concerns before treatment.
- Ask questions before receiving treatment if you do not understand the service, risks, aftercare, cost, or policies.
- Treat staff, providers, and other clients respectfully.
- Pay all amounts owed for services, products, packages, memberships, fees, or other charges.
- Keep your contact and payment information accurate and current.
Failure to follow instructions may increase risks, affect results, or result in Dermalaser LLC refusing or postponing treatment.
7. Appointments, Cancellations, No-Shows, and Late Arrivals
Appointments must be scheduled in advance and are subject to availability.
A valid credit card on file is required to book any appointment. No charge is made at the time of booking. Your card is charged only if a cancellation, no-show, or late-arrival fee applies under this policy.
Cancellation and Reschedule Fees
The fee for cancelling or rescheduling an appointment depends on how much notice you give:
- 24 hours or more before the appointment: no fee.
- Between 2 and 24 hours before the appointment: 50% of the service price, with a $50 minimum.
- Less than 2 hours before the appointment: 100% of the service price, with a $50 minimum.
No-Shows
If you miss your appointment without notice, it is treated as a cancellation made less than 2 hours before the appointment (100% of the service price, with a $50 minimum).
A no-show or late cancellation of a free consultation incurs a $50 fee.
Late Arrivals
We will do our best to accommodate late arrivals. However, arriving more than 15 minutes late may require your appointment to be shortened or rescheduled and may be treated as a same-day cancellation, charged at the under-2-hour rate (100% of the service price, with a $50 minimum).
Packages and Memberships
This cancellation policy applies to prepaid packages and memberships. For a prepaid package or membership, a late cancellation or no-show forfeits one session from your package or membership.
All cancellation, no-show, and late-arrival fees described in this section are charged to the card on file.
8. Pricing and Payment
Prices are subject to change at any time without prior notice, unless you have already purchased a specific service, package, promotion, or membership under written terms accepted by Dermalaser LLC.
Payment is due at the time of purchase or service, unless otherwise agreed in writing.
By providing a payment card or other payment method, you authorize Dermalaser LLC and its payment processors to charge your payment method for services, products, packages, memberships, cancellation fees, no-show fees, late-arrival fees, applicable taxes, outstanding balances, and any other amounts owed under these Terms or any written agreement.
Dermalaser LLC may decline, hold, freeze, or cancel a transaction if fraud, payment failure, chargeback risk, identity issues, sanctions compliance issues, or other payment concerns are suspected.
If payment fails, Dermalaser LLC may suspend access to services, packages, memberships, or benefits until the payment issue is resolved.
Card on File, Authorized Charges, and Chargebacks
As described in Section 7, a valid credit card on file is required to book an appointment, and no charge is made at the time of booking. Cancellation, no-show, and late-arrival fees charged under Section 7 are valid, authorized charges that you agree to in advance.
Initiating a chargeback, payment dispute, or reversal of a fee validly charged under these Terms is a breach of these Terms. If you believe a charge was made in error, you agree to contact Dermalaser LLC first so we can review and resolve it. Your responsibility for chargeback abuse is also addressed in Section 25 (Indemnification).
Men's Pricing
Men's treatment areas are typically larger, with denser, coarser hair, so each area takes more time and energy to treat. Men's pricing reflects a 20% adjustment over the standard price for that area (rounded up to the nearest $5). Exact areas and pricing are confirmed at the complimentary assessment.
9. Packages, Prepaid Services, and Memberships
Dermalaser LLC may offer prepaid packages, service bundles, series, plans, or memberships.
Unless otherwise stated in writing:
- Packages and memberships are personal to the purchasing client.
- Packages and memberships may not be transferred, shared, assigned, or sold.
- Unused sessions may expire according to the terms provided at purchase.
- Missed appointments, late cancellations, or no-shows may be subject to the applicable appointment policy.
- Services are subject to medical suitability, provider approval, and availability.
- Results are not guaranteed.
- Refunds are not provided except as required by law or expressly stated in writing by Dermalaser LLC.
9A. Laser Hair Removal and Laser Hair Removal Plans
9A.1 Nature of Treatment. Laser hair removal is a hair reduction treatment. It reduces the amount and appearance of unwanted hair; it does not guarantee permanent hair removal or complete elimination of hair. As described in Section 5, results vary and depend on factors including skin type, hair color and thickness, hormones, medications, treatment area, and individual response. The number of sessions needed varies by person and is not guaranteed.
9A.2 Suitability, Patch Tests, and Contraindications. Laser hair removal requires a consultation and may require a patch test, medical-history review, and provider approval before treatment. You agree to disclose all information requested under Section 4, including photosensitizing medications (such as isotretinoin/Accutane or antibiotics), pregnancy or breastfeeding, recent sun exposure or tanning, and any history of scarring, keloids, cold sores, or pigmentation issues. Dermalaser LLC may refuse, delay, or modify treatment if it determines treatment may not be safe or appropriate.
9A.3 Pre- and Post-Treatment Care. You agree to follow all pre- and post-treatment instructions, including avoiding sun exposure and tanning and refraining from plucking, waxing, threading, or electrolysis of the treatment area between sessions (shaving is permitted). Failure to follow instructions may reduce results, delay treatment, or make treatment unsafe, and may result in a session being forfeited.
9A.4 Treatment Spacing. A minimum of twenty-eight (28) days is required between sessions on the same area. Actual timing is guided by the provider based on your individual hair-growth cycle and response, which differ from person to person. Dermalaser LLC does not guarantee the availability of any specific appointment date or time.
9A.5 The 18-Month Plan. The 18-Month Plan is a time-based plan, not a fixed or guaranteed number of sessions.
- (a) Term. The Plan is valid for eighteen (18) months from the date of purchase.
- (b) Use. During the term, you may schedule treatments for the purchased area(s) as recommended by your provider, generally no more often than once every 28 days. The number of sessions you receive depends on how often you schedule and attend within the term, subject to availability and provider guidance. The Plan does not guarantee any particular number of completed sessions.
- (c) No Roll-Over; Forfeiture. Sessions do not accrue, bank, carry over, or extend beyond the term. Unused or unscheduled sessions have no cash value and are forfeited at the end of the 18-month term. Attending fewer times than the schedule allows does not entitle you to additional sessions, an extension, a credit, or a refund.
- (d) Personal to You. The Plan is personal to the purchasing client and may not be transferred, shared, assigned, or sold.
- (e) No Refunds. Once begun, a Plan is non-refundable except as required by law or expressly stated in writing (Section 16).
9A.6 Maintenance Touch-Ups. After you complete an 18-Month Plan for a given area, Dermalaser LLC may offer complimentary maintenance touch-ups for that area as a courtesy, for as long as Dermalaser LLC remains in business and continues to offer the program.
- (a) Courtesy, Not a Guarantee. Touch-ups are a courtesy and not a guaranteed, perpetual, or lifetime contractual entitlement. Dermalaser LLC may change, limit, suspend, or discontinue the touch-up program, in whole or in part, at any time and for any reason, with or without notice, subject to applicable law.
- (b) Conditions. Touch-ups are personal and non-transferable, subject to availability, the 28-day minimum, provider discretion, your continued medical suitability, and your account being in good standing. They have no cash value and are not redeemable for other services, credit, or refunds.
9A.7 Financing. Laser Plans may be paid in full or financed. Online purchases may be financed through Affirm; in-store purchases may be financed through Cherry. Financing is provided by third-party lenders under separate agreements between you and the lender (Section 22); Dermalaser LLC is not the lender and is not responsible for the lender's terms, approval, or rates.
9A.8 Men's Pricing. Men's treatment areas are priced as described in Section 8.
10. Monthly Memberships (DermaGlow, DermaFriends, and DermaPlus)
10.1 What's Included. Each membership includes one treatment per monthly billing cycle, selected by the member from that tier's menu, plus a member discount on additional treatments and retail products, and the loyalty rewards described for that tier. Current tiers, prices, included treatments, discounts, and rewards are as published at dermalaser.com and in our booking system at the time of purchase.
10.2 Billing, Term, and Auto-Renewal. Memberships are billed monthly in advance to the card on file and renew automatically each month until cancelled. By enrolling, you authorize Dermalaser LLC and its payment processor to charge your card the monthly fee each cycle, and you agree to a minimum commitment of six (6) months from the enrollment date.
10.3 Included Treatments; Accumulation Cap; Gifting.
- (a) Use. Included treatments are intended to be used within each billing cycle and are booked Tuesday–Friday, subject to availability.
- (b) Accumulation Cap. Unused included treatments may accrue up to a maximum of three (3); once three have accrued, no additional treatments accrue until some are used. Accrued treatments have no cash value and are forfeited on cancellation or expiration, except as required by law.
- (c) Gifting. A member may gift included treatments to another person, up to three (3) gifted treatments per calendar year, subject to availability, the recipient's medical suitability, and provider approval. Gifted treatments have no cash value.
10.4 Member Discounts and Loyalty Rewards. Member discounts apply to additional treatments and retail products only. They do not apply to, and do not stack with, other promotions, packages, gift cards, laser hair removal plans, or other discounts. Loyalty rewards (such as a milestone upgrade or anniversary gift) are courtesy benefits, are personal and non-transferable except as expressly allowed in Section 10.3(c), have no cash value, and may be changed or discontinued, subject to applicable law.
10.5 Cancellation. After the six-month minimum, you may cancel at any time by contacting Dermalaser LLC by phone, email, or in person, or by any method required by applicable law. Cancellation stops future monthly renewal charges. It does not refund prior payments, the current cycle, or used benefits, and does not refund or extend accrued or unused included treatments, except as required by law.
10.6 Three-Day Right to Cancel. You may cancel a new membership within three (3) business days of enrollment for a refund of amounts paid, provided no included treatments or member benefits have been used.
10.7 Freeze or Hold. You may request to freeze a membership for a limited period (generally one to three months per calendar year). Medical holds are handled under Section 11. Approval is at Dermalaser LLC's discretion unless otherwise required by law.
10.8 Price Changes. Dermalaser LLC may change membership prices or benefits on a going-forward basis with advance notice as required by law; changes do not affect the current paid cycle.
11. Medical Holds or Freezes
If you are unable to receive services for medical reasons, you may request a temporary hold or freeze of a package or membership.
Dermalaser LLC may require written documentation from a licensed medical provider stating that you are unable to receive the service for medical reasons and providing the expected duration of the restriction.
Approval of a medical hold or freeze is at Dermalaser LLC’s discretion unless otherwise required by law or by a written membership agreement.
A medical hold does not automatically entitle a client to a refund.
12. Promotions, Introductory Offers, and Discounts
Dermalaser LLC may offer promotions, introductory offers, free first-session offers, discounted services, loyalty offers, or limited-time specials.
Unless otherwise stated in writing:
- Promotions are subject to availability.
- Promotions may be limited to new clients, specific services, specific treatment areas, or specific dates.
- Promotions are limited to one per client.
- Promotions cannot be combined with other discounts, packages, memberships, gift cards, loyalty credits, or offers.
- Promotions are non-transferable and have no cash value.
- A valid credit card may be required to book a promotional appointment.
- Clients must be medically suitable and approved for the service before receiving treatment.
- If a client is not eligible or medically suitable, Dermalaser LLC may deny, postpone, or modify the service.
- Late cancellations and no-shows may count as redemption of the offer and/or may be subject to the applicable cancellation/no-show policy.
- Fraud, duplicate accounts, misrepresentation, or use of another person’s account to redeem a promotion may result in cancellation of the offer.
Dermalaser LLC reserves the right to modify, suspend, or cancel promotions at any time, subject to applicable law.
13. Gift Cards and Gift Certificates
Dermalaser LLC may offer gift cards or gift certificates.
Gift cards and gift certificates are not redeemable for cash except as required by law. Gift cards may be used only for eligible Dermalaser LLC services or products, unless otherwise stated at the time of purchase.
Purchased gift cards or gift certificates issued in Florida generally should not have expiration dates, expiration periods, dormancy fees, account maintenance fees, service fees, or similar post-sale charges, except where a legal exception applies.
Promotional credits, loyalty rewards, donated certificates, charitable certificates, employee incentives, or free promotional offers may be subject to different expiration rules if permitted by law and clearly disclosed.
Lost, stolen, or unauthorized use of gift cards may not be replaced except as required by law.
14. Loyalty Program
Dermalaser LLC may offer a loyalty or rewards program.
Unless otherwise stated in writing:
- Loyalty accounts are personal to the client.
- Points, credits, rewards, or benefits are not transferable.
- Points or rewards have no cash value.
- Points or rewards may expire according to the program terms.
- Points or rewards may not be combined with certain promotions or discounts.
- Dermalaser LLC may adjust points for returns, cancellations, refunds, errors, suspected fraud, or account misuse.
- Dermalaser LLC may change, suspend, or discontinue the loyalty program at any time, subject to applicable law.
- Abuse, fraud, duplicate accounts, or misrepresentation may result in cancellation of points, benefits, or program participation.
15. Products and Retail Sales
Dermalaser LLC may sell skincare, wellness, or related products.
Product purchases are subject to availability. Product recommendations are general and may not be suitable for every client. You are responsible for reviewing ingredients, instructions, warnings, and contraindications before use.
Unless otherwise stated, opened or used products may not be returnable. Defective products or product returns will be handled according to Dermalaser LLC’s posted policy and applicable law.
16. Refund Policy
All sales of services, completed treatments, packages, memberships, promotional offers, and prepaid services are final unless otherwise stated in writing or required by law.
Refund requests will be reviewed on a case-by-case basis.
Dermalaser LLC does not provide refunds simply because a client:
- Is dissatisfied with results
- Missed appointments
- Failed to follow instructions
- Changed their mind
- Moved
- No longer wishes to continue
- Did not complete the recommended treatment schedule
- Was late or did not attend appointments
- Used part of a package or membership
If Dermalaser LLC determines that a client is not medically eligible for a prepaid service before beginning that prepaid service or package, Dermalaser LLC may offer a refund, credit, exchange, or other resolution depending on the circumstances, the terms of purchase, and applicable law.
Refunds, when approved, may be reduced by the value of services already received, discounts applied, products received, chargeback fees, financing fees, cancellation fees, or other amounts owed, where permitted by law.
17. Communications, Email, Calls, and Text Messages
By providing your phone number, email address, or other contact information, you agree that Dermalaser LLC may contact you regarding appointments, scheduling, forms, confirmations, reminders, payments, account status, service updates, post-care instructions, promotions, memberships, packages, loyalty program updates, policy changes, client service matters, and legal notices.
Dermalaser LLC may communicate by phone, email, text message, website, booking platform, client portal, social media message, or other electronic methods.
Marketing text messages, calls, and emails will be handled in accordance with applicable law. Consent to receive promotional messages is not required as a condition of purchasing services.
You may opt out of promotional text messages by following the instructions provided in the message, such as replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT, where applicable. You may opt out of promotional emails by using the unsubscribe link or contacting Dermalaser LLC.
Even if you opt out of promotional communications, Dermalaser LLC may still contact you about appointments, transactions, payments, forms, safety issues, service-related matters, or legal notices where permitted by law.
Message and data rates may apply.
You are responsible for providing your own current and valid phone number and email address. If your phone number or email changes, you agree to notify Dermalaser LLC.
18. Privacy
Dermalaser LLC’s collection, use, disclosure, and protection of personal and health-related information is described in our Privacy Policy.
By using our website, booking services, submitting information, or receiving services, you acknowledge that you have had the opportunity to review our Privacy Policy.
19. Photos, Videos, Reviews, and Testimonials
Dermalaser LLC may take photos or videos for treatment records, progress tracking, documentation, training, or quality purposes when appropriate and permitted.
Dermalaser LLC will not use your identifiable image, likeness, testimonial, review, name, or treatment photos for marketing, website, advertising, or social media purposes without your written authorization.
If you voluntarily post, tag, review, message, or interact with Dermalaser LLC on social media or public platforms, your activity may be visible to others depending on the platform and your privacy settings.
20. Website Use
Dermalaser LLC grants you a limited, non-exclusive, non-transferable right to access and use our website for personal, non-commercial purposes.
You may not:
- Copy, reproduce, modify, distribute, sell, or exploit website content without written permission.
- Use the website for unlawful, fraudulent, misleading, abusive, or harmful purposes.
- Interfere with the security or operation of the website.
- Attempt to access non-public systems or data.
- Use bots, scrapers, crawlers, automated tools, or data-mining tools without written permission.
- Submit false, misleading, defamatory, infringing, or unlawful content.
- Impersonate another person or misrepresent your identity.
- Use our name, logo, trademarks, photos, service descriptions, or content without written permission.
- Send viruses, malware, spam, or harmful code.
- Violate any applicable law or regulation.
Dermalaser LLC may suspend or restrict access to the website or services if these Terms are violated.
21. Intellectual Property
All website content, service descriptions, branding, text, graphics, images, logos, designs, and other materials owned or used by Dermalaser LLC are protected by intellectual property laws.
You may not use Dermalaser LLC’s name, logo, images, content, or materials for commercial purposes without prior written permission.
Any feedback, ideas, suggestions, or comments you voluntarily provide to Dermalaser LLC may be used by Dermalaser LLC without compensation to you, unless otherwise agreed in writing.
22. Third-Party Links and Platforms
Dermalaser LLC may use or link to third-party websites, booking platforms, payment processors, financing providers, social media platforms, email providers, text messaging providers, or other service providers.
Dermalaser LLC is not responsible for the content, availability, security, accuracy, privacy practices, or policies of third-party websites or platforms. Your use of third-party platforms may be subject to their own terms and privacy policies.
23. Disclaimer of Warranties
To the fullest extent permitted by law, Dermalaser LLC’s website, online content, booking tools, communications, products, and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
Dermalaser LLC does not warrant that the website, booking system, communications, or digital services will be uninterrupted, error-free, secure, or free of viruses or harmful components.
No oral or written statement by Dermalaser LLC creates any warranty unless expressly stated in a written agreement signed by Dermalaser LLC.
24. Limitation of Liability
To the fullest extent permitted by law, Dermalaser LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, loss of goodwill, or similar damages arising from your use of our website, communications, products, services, or inability to use them.
To the fullest extent permitted by law, Dermalaser LLC’s total aggregate liability for any claim arising out of or relating to a service or product is limited to the amount you actually paid to Dermalaser LLC for the specific service or product that gave rise to the claim.
This liability cap does not apply to liability for death or personal injury caused by Dermalaser LLC’s gross negligence, and it does not limit or exclude any liability that cannot be limited or excluded under applicable law.
Nothing in these Terms is intended to limit liability where such limitation is not permitted by applicable law.
Nothing in these Terms is intended to waive rights that cannot legally be waived.
25. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dermalaser LLC, its owners, managers, employees, contractors, providers, agents, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:
- Your misuse of the website or services
- Your violation of these Terms
- Your violation of applicable law
- Your inaccurate or incomplete information
- Your failure to follow pre-care, post-care, safety, or treatment instructions
- Your violation of another person’s rights
- Your fraud, misrepresentation, chargeback abuse, or unauthorized use of another person’s account or payment method
26. Refusal of Service and Client Conduct
Dermalaser LLC reserves the right to refuse, discontinue, or reschedule service when appropriate, including for safety, medical, operational, legal, payment, or conduct-related reasons.
Dermalaser LLC may refuse service to any client who refuses to agree to Dermalaser LLC’s current Terms of Service, including the required arbitration agreement and jury trial waiver, as a condition of receiving future non-emergency elective services.
Dermalaser LLC may also refuse service to any client who engages in abusive, threatening, harassing, discriminatory, inappropriate, unsafe, fraudulent, or disruptive behavior.
Dermalaser LLC will not refuse service for an unlawful discriminatory reason.
27. Changes to Services, Prices, and Terms
Dermalaser LLC may update services, pricing, policies, website content, promotions, and these Terms at any time, subject to applicable law.
Updated Terms may be posted on our website, provided electronically, or made available upon request.
Continued use of our website, booking tools, purchases, appointments, or services after updated Terms are posted or provided means you accept the updated Terms for future use, purchases, appointments, and services.
Changes to these Terms do not automatically change the price, refund terms, cancellation terms, or benefits of a package, membership, or service already purchased unless the applicable written agreement permits the change or the change is required by law.
28. Cancellation or Termination of These Terms
You may stop using Dermalaser LLC’s website, services, booking tools, communications, packages, memberships, or programs at any time.
However, stopping use or cancelling future services does not automatically:
- Cancel amounts already owed
- Refund completed services
- Refund used packages or memberships
- Eliminate cancellation fees, no-show fees, chargeback fees, or unpaid balances
- Cancel obligations that arose before cancellation
- Cancel a separate signed agreement, financing agreement, membership agreement, treatment consent, or package agreement
- Cancel the arbitration agreement for disputes relating to events that occurred while these Terms applied
Dermalaser LLC may suspend or terminate your access to services, packages, memberships, promotions, loyalty points, website access, or future appointments if you violate these Terms, fail to pay amounts owed, provide inaccurate information, create a safety concern, abuse promotions, misuse accounts, or engage in inappropriate conduct.
Certain provisions of these Terms survive cancellation or termination, including payment obligations, refund policies, intellectual property rights, disclaimers, limitation of liability, indemnification, privacy obligations, dispute resolution, arbitration, jury trial waiver, and any other provision that by its nature should continue after termination.
Practical Effect of Cancelling These Terms
For a client, cancelling or rejecting these Terms generally means the client should stop using Dermalaser LLC’s website, booking tools, and services. It does not erase past transactions or obligations.
For Dermalaser LLC, cancellation or termination allows the business to stop providing future access or services when appropriate, but it does not eliminate obligations already owed to clients under signed agreements, applicable law, or completed purchases.
For both parties, the arbitration agreement and dispute-resolution provisions continue to apply to disputes connected to prior use, prior purchases, prior appointments, prior services, or prior communications.
29. Governing Law
These Terms and any dispute between you and Dermalaser LLC shall be governed by the laws of the State of Florida and applicable federal law, including the Federal Arbitration Act where applicable.
To the extent Florida arbitration law applies, the parties intend that the arbitration agreement be interpreted consistently with the Florida Revised Arbitration Code, Chapter 682, Florida Statutes.
30. Dispute Resolution, Binding Arbitration, and Jury Trial Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
ARBITRATION IS REQUIRED. THERE IS NO ARBITRATION OPT-OUT RIGHT UNDER THESE TERMS.
Arbitration is a condition of using Dermalaser LLC’s website, booking services, purchasing products, purchasing packages or memberships, participating in promotions, and receiving non-emergency elective aesthetic, wellness, skincare, laser, body, massage, or related services from Dermalaser LLC. If you do not agree to this arbitration agreement, you should not use the website, book services, purchase services, or receive services from Dermalaser LLC.
By using Dermalaser LLC’s website, booking an appointment, purchasing services, purchasing products, purchasing a package or membership, participating in a promotion, communicating with Dermalaser LLC, or receiving services from Dermalaser LLC, you and Dermalaser LLC agree that any dispute, claim, or controversy arising out of or relating to Dermalaser LLC, our website, services, products, packages, memberships, promotions, communications, these Terms, or any relationship between you and Dermalaser LLC shall be resolved as described in this section.
30.1 Informal Resolution First
Before either party files a claim in arbitration or court, you and Dermalaser LLC agree to first try to resolve the dispute informally and in good faith.
To begin the informal resolution process, the party raising the dispute must provide written notice describing the issue, the requested resolution, and current contact information.
Clients may send notice to:
Dermalaser LLC
10560 NW 27th St #102, Doral, FL 33172
Miami-Dade County, Florida
Email: info@dermalaser.com
Dermalaser LLC may send notice to the most recent email address, mailing address, phone number, or other contact information provided by the client.
Dermalaser LLC will make a reasonable effort to review and respond to the concern.
If the dispute is not resolved within thirty (30) days after written notice is received, either party may proceed as provided below.
30.2 Agreement to Binding Arbitration
Except for claims that qualify for small claims court, you and Dermalaser LLC agree that any dispute, claim, or controversy arising out of or relating to Dermalaser LLC, our website, services, products, packages, memberships, promotions, communications, these Terms, or any relationship between you and Dermalaser LLC will be resolved by final and binding arbitration rather than in court.
Arbitration is a private dispute resolution process. There is no judge or jury in arbitration, and court review of an arbitration award is limited.
30.3 Small Claims Court Exception
Either you or Dermalaser LLC may bring an individual claim in small claims court if the claim qualifies and remains only in small claims court.
If a claim is filed in small claims court and is later transferred, removed, appealed, or no longer qualifies as a small claims matter, either party may require the claim to proceed in arbitration.
30.4 Arbitration Administrator, Rules, and Location
The arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
If AAA is unavailable, declines to administer the arbitration, or cannot administer the arbitration for any reason, the parties shall use JAMS under its consumer arbitration standards or another mutually agreed arbitration provider.
Unless otherwise required by law or agreed in writing, the arbitration shall take place in Miami-Dade County, Florida, or remotely by video or telephone if permitted by the arbitrator and applicable rules.
The parties intend for the arbitration process to be fair, neutral, and consistent with applicable consumer arbitration standards.
30.5 Initiating Arbitration
A party initiating arbitration must provide written notice in a record to the other party.
The notice should include:
- The name, address, phone number, and email address of the party initiating arbitration
- A description of the dispute
- The requested relief
- A statement that the informal resolution process was attempted
- Any information required by the arbitration administrator’s rules
Notice to Dermalaser LLC must be sent to:

30.6 Arbitrator Selection
The arbitrator shall be neutral.
If the parties agree on a method for selecting an arbitrator, that method shall be followed. If the parties do not agree, the arbitrator shall be selected according to the rules of the arbitration administrator.
The arbitrator should be either a retired judge or an attorney licensed to practice law, unless otherwise agreed by the parties or required by the arbitration administrator’s rules.
30.7 Authority of the Arbitrator
The arbitrator shall have authority to decide the merits of the dispute and award individual relief permitted by law.
The arbitrator may award damages, declaratory relief, injunctive relief, fees, or costs only to the extent such relief is available under applicable law and only for the individual party bringing the claim.
30.8 Court Authority
A court of competent jurisdiction may decide issues that applicable law requires a court to decide, including whether an enforceable arbitration agreement exists.
A court may also enforce, confirm, modify, correct, or vacate an arbitration award as permitted by applicable law.
30.9 Governing Law for Arbitration
This arbitration agreement is governed by the Federal Arbitration Act and applicable Florida law, including Chapter 682, Florida Statutes, to the extent not preempted by federal law.
30.10 Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND DERMALASER LLC KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO DERMALASER LLC, OUR WEBSITE, SERVICES, PRODUCTS, PACKAGES, MEMBERSHIPS, PROMOTIONS, COMMUNICATIONS, THESE TERMS, OR ANY RELATIONSHIP BETWEEN YOU AND DERMALASER LLC.
30.11 Arbitration Fees and Attorneys’ Fees
Each party shall be responsible for its own attorneys’ fees and costs unless:
- The arbitrator determines otherwise under applicable law
- A specific statute provides otherwise
- The arbitration administrator’s consumer rules require otherwise
- The parties agree otherwise in writing
Arbitration fees shall be handled according to the rules of the arbitration provider and applicable law.
Dermalaser LLC will not require a client to pay arbitration fees that the client would not be required to pay under applicable consumer arbitration rules or applicable law.
In addition, if the arbitrator finds that a claim, counterclaim, or defense was frivolous, brought in bad faith, or brought for an improper purpose — such as to harass or to extract a settlement — the arbitrator may award the prevailing party its reasonable attorneys’ fees and costs, to the fullest extent permitted by Florida law.
30.12 Confidentiality
To the extent permitted by law, the parties agree that arbitration proceedings, filings, documents, testimony, and awards shall remain confidential, except as necessary to enforce or challenge an arbitration award, comply with law, comply with regulatory obligations, or obtain legal, accounting, insurance, or professional advice.
30.13 Limitation Period
Any claim or dispute must be brought within the applicable statute of limitations under Florida law. If it is not brought within that period, it will be barred to the fullest extent permitted by law.
30.14 Changes to the Arbitration Agreement
If Dermalaser LLC makes a material change to this arbitration agreement, Dermalaser LLC will make the updated Terms available by posting them, providing electronic notice, or otherwise making them available as required by law.
Your continued use of Dermalaser LLC’s website, booking tools, services, purchases, appointments, or communications after the updated Terms become effective will constitute acceptance of the updated arbitration agreement for future disputes, unless prohibited by law.
30.15 Severability
If any part of this arbitration section is found to be invalid or unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.
30.16 Survival
This arbitration agreement survives cancellation, termination, expiration, completion of services, completion of purchases, cancellation of memberships, cancellation of packages, and the end of any relationship between you and Dermalaser LLC.
31. Court Venue for Non-Arbitrable Claims
For any claim or dispute that is not subject to arbitration and is not filed in small claims court, the parties agree that the claim shall be filed in the appropriate state or federal court located in Miami-Dade County, Florida, unless otherwise required by law.
You and Dermalaser LLC consent to personal jurisdiction and venue in Miami-Dade County, Florida for such claims.
32. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect.
33. Assignment
You may not assign or transfer these Terms, any package, membership, loyalty account, promotion, gift card, service credit, or appointment without Dermalaser LLC’s prior written consent, unless otherwise required by law.
Dermalaser LLC may assign or transfer these Terms as part of a merger, sale, restructuring, transfer of assets, change of ownership, or business transaction, subject to applicable law.
34. Force Majeure
Dermalaser LLC shall not be liable for delays, cancellations, closures, or inability to perform caused by events outside its reasonable control, including acts of God, hurricanes, floods, fire, pandemics, government orders, power outages, labor shortages, supply shortages, equipment failure, internet or software outages, civil unrest, terrorism, war, or other events beyond reasonable control.
35. Entire Agreement
